These Terms govern your access to and use of Bitwell Crypto’s exchange services, including trading, custody, deposits, withdrawals, and related features.

1. Acceptance of these Terms

By creating an account, accessing, or using Bitwell Crypto’s services (“Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.

2. Eligibility

You must be legally able to enter into these Terms and comply with applicable laws in your jurisdiction. We may restrict or refuse Services in certain regions or to certain persons as required by law, regulation, or risk policy.

3. Account, Security & Access

  • Accurate information: You agree to provide true, current, and complete information.
  • Security: You are responsible for safeguarding your credentials, 2FA, and device access.
  • Unauthorized activity: Notify Support immediately if you suspect account compromise.

4. Services

Services may include digital asset trading, custody, transfers, market data, and related account tools. Availability of specific assets and features may change.

Digital assets can be volatile. You may lose some or all of your funds. Past performance does not guarantee future results.

5. Deposits

Deposits may require network confirmations. You are responsible for using the correct network and address. Incorrect deposits may be unrecoverable.

6. Withdrawals

Withdrawals may be subject to limits, security holds, network congestion, and compliance/risk reviews. We may delay or refuse a withdrawal where required by law, regulation, sanctions screening, fraud prevention, or to protect you and the platform.

6.1 Security holds

Certain actions (for example: password changes, new device login, or 2FA changes) may trigger a temporary hold on withdrawals.

6.2 Destination responsibility

You are responsible for recipient address accuracy and selecting the correct transfer network. Once broadcast, transfers may be irreversible.

7. Fees

Fees may include trading fees, withdrawal network fees, spreads, and other service charges. Applicable fees will be shown before you confirm a transaction where practicable.

8. Risk Reviews & High-Risk Verification

Certain accounts or transactions may be flagged by our security and compliance systems for additional review (“High-Risk Verification”). During review, we may request additional documents or information to verify identity, source of funds, transaction purpose, or account control.

9. Insurance Coverage

Account with high-risk verification state. A 10% insurance fee is required. This measure helps secure the transfer process and guarantees full delivery of your funds. Once the withdrawal is successfully completed and confirmed by our compliance system, the insurance fee will be automatically refunded to your wallet balance

10. Credit Score

Account credit score will be affected due to a history of delayed or incomplete payments. To make a withdrawal, a minimum score of 95 is required.

10.1 What it is (and isn’t)

  • It is: an internal security/compliance indicator based on signals like device changes, verification status, and unusual activity.
  • It is not: a consumer credit score or a promise of approval, profit, or platform access.

10.2 Restore credit score

To restore your credit score, the system allows score recovery through account funding: Credit score rate: 1 point = 100 USD.

11. Compliance - KYC/AML/Sanctions

We may require identity verification (KYC) and monitor activity for AML, counter-terrorist financing, and sanctions compliance. We may freeze or restrict access as required by law or where suspicious activity is detected.

12. Prohibited Use

You agree not to use the Services to:

  • Violate any law, regulation, sanctions, or third-party rights.
  • Engage in fraud, deception, market manipulation, or money laundering.
  • Attempt to exploit vulnerabilities or disrupt the platform.
  • Use the Services on behalf of others without authorization or required approvals.

13. Suspension & Termination

We may suspend or terminate access to Services if we reasonably believe you violated these Terms, pose a risk to the platform, or as required by law. We will provide notice where feasible and legally permitted.

14. Disclaimers

Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Bitwell Crypto will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Services.

16. Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Services, you consent to data processing consistent with that policy.

17. Changes to Terms

We may update these Terms from time to time. Where required, we will provide notice (e.g., in-app, email, or website notice). Continued use after the effective date constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws applicable to Bitwell Crypto’s operating entity and jurisdiction, without regard to conflict-of-law rules.
